Swarovski’s Masters of Light Hollywood Exhibition Tickets
1. PLEASE READ THE FOLLOWING TERMS CAREFULLY AS THEY GOVERN YOUR RIGHTS UNDER THE TICKET AND CONTAIN A BINDING, INDIVIDUAL ARBITRATION AND CLASS-ACTION WAIVER PROVISION BY WHICH YOU GIVE UP THE RIGHT TO FILE A LAWSUIT IN COURT INDIVIDUALLY OR AS PART OF A CLASS ACTION WITH RESPECT TO ANY DISPUTES RELATING TO THE TICKET OR EVENT FOR WHICH IT IS ISSUED.
2. General
A. These Terms & Conditions of Sale (the “Terms”) apply to all purchases of tickets (each, a “Ticket”) to Swarovski’s Masters of Light Hollywood Exhibition (the “Event”).
B. Tickets to the Event are sold by Swarovski North America Limited (hereinafter referred to as “Swarovski / We / Us / Our”).
C. By purchasing a Ticket, You, on behalf of yourself and any minor(s) or legally incapacitated adult(s) accompanying you (collectively “You”), agree to these Terms.
D. Each Ticket is a license to attend the Event; each such license is revocable in Swarovski’s sole discretion.
E. If You fail to comply with these Terms or with venue rules, or if You exhibit any conduct which Swarovski, in its sole discretion, deems disorderly or abusive, You may be subject to non-admission, ejection from the Event and/or other available legal remedies. Swarovski reserves the right, for any reason or no reason, to refuse admission or eject any person from the Event.
3. ALL TICKET SALES ARE FINAL. NO REFUNDS, CREDITS OR EXCHANGES EXCEPT AS PROVIDED HEREIN.
A. THE SOLE AND EXCLUSIVE REMEDY (IF ANY) if admission is refused or revoked, or the Event is cancelled and not RESCHEDULED, is a refund of up to the Ticket’s face value as set by Swarovski (the “Face Value”). IN NO EVENT SHALL THE RELEASED PARTIES (as defined below) BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT OR EXEMPLARY DAMAGES OF ANY KIND, OR ANY DAMAGES BEYOND THE FACE VALUE OF THE TICKET, INCLUDING, WITHOUT LIMITATION, ANY AMOUNT PAID IN EXCESS OF FACE VALUE FOR THIS TICKET.
B. The Event date and time are subject to change by Swarovski, in its sole discretion, and no such change shall entitle You to a refund or other remedy if You cannot attend or for any other reason.
C. Inclement weather
i. If the Event continues to operate, there will be no refunds or exchanges.
ii. If the Event is cancelled, ticketholders will be entitled to a refund or, subject to availability, may be able to select a new Event date and/or time.
iii. YOU ACKNOWLEDGE THAT YOU ARE NOT ENTITLED TO ANY REFUND IN THE EVENT OF A RESCHEDULING OF THE EVENT, OR A RESCHEDULING OF YOUR SELECTED TIME SLOT.
iv. Swarovski is not responsible for any costs or damages incurred by You in the event of a postponement or cancellation.
4. Prohibited Items
A. No food or drink is allowed inside the Event.
B. Smoking and vaping is not allowed.
C. No weapons or other dangerous items are allowed. By using the Ticket, You consent to a reasonable search and screening and waive any claims that may arise therefrom against Swarovski, its affiliates, or the Released Parties (as defined below).
D. Only service animals are permitted inside the Event; no pets or other animals may enter.
5. Limitations on Your Use of the Ticket
A. Your Ticket may not be used for any commercial purpose (for example, advertising, promotion, sweepstakes, giveaways, gambling or gaming) without Swarovski’s express written consent.
B. Resale or attempted resale in violation of any applicable law is grounds for cancellation of the Ticket without refund or compensation.
C. Commercial solicitation is not permitted on the Event premises.
D. You agree not to give or offer this Ticket in a manner that would constitute a violation of the U.S. Foreign Corrupt Practices Act, any other anti-bribery law or regulation, or any conflicts of interest law, regulation or policy.
6. PLEASE READ THIS SECTION CAREFULLY – IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT. YOU HAVE THE LIMITED RIGHT TO OPT OUT OF THE ARBITRATION AGREEMENT IN THIS PARAGRAPH AS SET FORTH BELOW. THIS IS A SUMMARY OF MANDATORY TERMS.
A. Should any current or future dispute, claim or cause of action related to this Ticket or the Event arise between You and Swarovski, a written notice (a “Dispute Notice”) must be sent with the following information: (i) name, contact information (address, telephone number, and email address), and account information if applicable; (ii) a description of the nature and basis of the dispute; and (iii) a description of the nature and basis of the relief sought, including a calculation for it. If You have a dispute, You shall send the Dispute Notice to: Swarovski North America Limited, 50 Sharpe Drive, Cranston, RI 02920, Attn: Legal Department. You and Swarovski agree to make a good-faith effort to resolve the dispute for at least 60 days (the “Negotiation Period”) following receipt of the Dispute Notice. If the parties cannot resolve the dispute within the Negotiation Period, the dispute shall be resolved by binding arbitration. The arbitration shall be administered by National Arbitration and Mediation (“NAM”) and heard by a single, neutral arbitrator. The NAM Rules shall govern the payment of all arbitration fees. Notwithstanding the foregoing, Swarovski will consider a request to reimburse your portion of the arbitration fees upon a showing of hardship in its sole discretion and assuming you do not qualify for a waiver from NAM. All issues are for the arbitrator to decide except the following items (which are for a court of competent jurisdiction to decide): (i) issues that are specifically reserved for a court; (ii) issues related to the scope and enforceability of the arbitration provisions; and (iii) whether a dispute can or must be brought in arbitration. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND SWAROVSKI AGREE THAT ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO LITIGATE IN COURT OR ARBITRATE ANY CLAIM AS A CLASS ACTION, REPRESENTATIVE ACTION, OR CLASS ARBITRATION. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND SWAROVSKI WAIVE THE RIGHT TO A JURY TRIAL. There are also additional procedures for “mass filings,” as set forth in the NAM Rules. In addition, these terms and any disputes between You and Swarovski will be governed by the laws of the State of New York without regard to its principles of conflicts of laws. To the fullest extent permitted by law, the state and federal courts of New York, New York, shall have exclusive jurisdiction over any disputes between You and Swarovski (except for disputes brought in small claims court) that are not subject to arbitration. IF YOU DO NOT CONSENT TO THIS CLAUSE, YOU MUST IMMEDIATELY LEAVE OR NOT ENTER THE EVENT. You have the right to opt out of arbitration under these Terms by sending a personally signed, written notice of your decision to opt out via email to legal@swarovski.com within the earlier of the Event date or thirty (30) days after purchase of your Ticket. Such an opt out will not opt You out of an arbitration agreement you might otherwise have with Swarovski.
7. Waiver & Release of Liability
A. On behalf of Yourself and any Related Persons (defined below), You further hereby release (and covenant not to sue) each of the Released Parties (defined below) with respect to any and all claims that You or any Related Persons may have (or hereafter accrue) against any of the Released Parties and that relate in any way to (i) exposure to COVID-19; (ii) entry into, or presence within or around, the Event (including all risks related thereto) or compliance with any protocols or Safety Requirements applicable to the Event; or (iii) any interaction between You and any Related Persons, on the one hand, and any personnel of any of the Released Parties present at the Event, on the other hand, in each case whether caused by any action, inaction or negligence of any Released Party or otherwise. You understand that the foregoing release discharges the Released Parties from any and all liability or claims You or any Related Persons may have against the Released Parties with respect to but not limited to bodily injury, personal injury, illness, death, property damage and any and all other liability that may arise out of or be attributable to Your attendance at the Event, including but not limited to those claims that may be unknown to You, or which You do not suspect to exist at this time. On behalf of You and any Related Persons, You expressly waive all rights, benefits, and protections You or any Related Persons may have under California Civil Code Section 1542, which reads as follows: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.
i. As used herein:
1. “Related Persons” means Your heirs, assigns, executors, administrators, next of kin, anyone attending the Event with You or for whom You have obtained an Event ticket (which persons You represent have authorized You to act on their behalf for purposes of these terms), and other persons acting or purporting to act on Your or their behalf.
2. “Released Parties” means: (i) Swarovski and each of its respective direct and indirect parent companies, subsidiaries, affiliates, employees, administrators, designees, licensees, and other personnel; (ii) the direct and indirect owners, lessees and sublessees of the Event space; (iii) all third parties performing services at the Event; (iv) any parents, subsidiaries, affiliated and related companies of each of the entities described in clauses (i)-(iii); and (v) the officers, directors, owners, members, managers, partners, employers, employees, agents, contractors and sub-contractors (and employees of such contractors and sub-contractors), insurers, representatives, other personnel, successors and/or assigns of each of the foregoing entities and persons described in clauses (i) – (iv), whether past, present or future and whether in their institutional or personal capacities.
8. Except as specifically provided herein, if any provision of these Terms is held by a court of competent jurisdiction to be unlawful, void, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.
9. In the event of a conflict between any applicable ticket service provider’s terms and these Terms, these Terms will apply.
- Please have your Ticketmaster confirmation code ready on your phone for swift entry.
- Entry is valid for the time slot selected at purchase. If you arrive 15 minutes or more after the scheduled time, you may have to wait until an opening arises. Should you arrive earlier than the set time, if an opening is available you will be able to enter the exhibition.
- We recommend arriving 10-15 minutes early.
- Ride-share recommended (drop-off at Amoeba Records entrance at 6400 Sunset Blvd).
- Please allow extra time for Hollywood traffic.
- Bags subject to inspection; oversized items may be restricted.
- Food & beverages are not permitted inside the exhibition.
- After your visit, book a styling appointment at our LA Swarovski stores – Century City, Beverly Center, Glendale Galleria, and South Coast Plaza, and enjoy a 20% shopping voucher.
