SWAROVSKI DATA PRIVACY POLICY

This “Privacy Policy” describes how SWAROVSKI Digital Business USA Inc. and its affiliates, including SWAROVSKI North America Limited and SWAROVSKI Retail Ventures Limited (collectively, “SWAROVSKI”) collect, use and disclose Personal Information about you to create a more sparkling world. By interacting with SWAROVSKI through our stores, Loyalty Programs, Sites (defined below), applications, products, or any other applications or services that link to this Privacy Policy (including third-party social media platforms with a social commerce component, such as Facebook, Instagram, or Tik Tok), you consent to the collection, use and disclosure of Personal Information about you as described in this Privacy Policy. (Please note that we have no control over the privacy practices of third-party websites, applications, or social media platforms that we do not own. We are not responsible for the activities and practices that take place on these websites. Accordingly, we recommend that you review the privacy policy or privacy notice/statement posted on any external website before disclosing any personal information. Please contact those websites directly if you have any questions about their privacy policies.) This Privacy Policy does not apply in the context of applying for a job or working at or for Swarovski, or for business to business transactions; see the links at the bottom this Privacy Policy for links to the applicable privacy policies in these contexts.
SWAROVSKI collects, processes, discloses, holds, and uses your Personal Information and data securely, fairly, and lawfully in accordance with relevant U.S. federal and state laws that apply to SWAROVSKI and your Personal Information. Such processing may be carried out electronically and automatically. Under certain applicable laws we may be considered a “Controller” of your Personal Information. We may change this Privacy Policy from time to time to make sure it complies with applicable laws and conforms to changes in our business. If we make changes, we will post the revised version of the Privacy Policy on our websites and online shop, including www.swarovski.com/en-US (the “Sites”), We will update the “Last Updated” date at the top of this page, and may notify you in other ways as appropriate. We encourage you to review this page regularly to ensure you are comfortable with any revisions. If you have received a paper copy of this Privacy Policy through one of our retail stores, please note that updates will be posted on the Sites. Your continued interaction with SWAROVSKI through our Sites, stores, Loyalty Programs, or other services constitutes your acceptance of the terms of this Privacy Policy as amended or revised by us from time to time.
“Personal Information” includes information that identifies, relates to, describes, or is capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household. Personal Information does not include aggregated or anonymized information.
Types of Personal Information we may collect include:

- Information required for our third-party payment processor to process your payments;
- Purchase and/or return history, including use of vouchers or discount offers;

- Information you provide or submit to us, as described in more detail below; and
- Information we may collect automatically or passively, as described in more detail below.
Using Personal Information we collect from and about you, we may draw inferences about you, reflecting what we believe to be your preferences, characteristics, predispositions, and attitudes. Additional types of Personal Information we collect, use, and disclose are described below.
We collect information you provide directly to us. This can occur, for example, by registering your contact details with SWAROVSKI, making a purchase on our Sites, enrolling in a sweepstakes, enrolling in one of our loyalty programs, e.g. SWAROVSKI Club or SWAROVSKI Crystal Society (“Loyalty Programs”), online or in our stores, signing up for a newsletter or other communication, participating in a survey or special event or promotion, contacting customer service, or communicating with us through online chat. For example we collect and retain the Personal Information provided on our Loyalty Programs SWAROVSKI Club sign-up form (including but not limited to: title, name and address, telephone number and e-mail address; “Form Data”). We also collect and retain any Personal Information provided voluntarily by Loyalty Program members on the members page, in their account, when interacting with us in store, via telephone, email, chat or online, such as date of birth, gender, as well as styles/interests (e.g. in Jewelry and Accessories, Home and Style, Wedding, Figures and Collectables and/or Watches; Classic style; etc.), data related to appointments, social media accounts (and related information collected through social log-in), wish lists, gender, IP address and online identifiers.
In addition, and where available, with consent, when chat and video functionalities are activated by accepting cookies, SWAROVSKI offers the possibility to communicate with SWAROVSKI (via chat or video calls). The use of this technology allows us to locate visitors and give them the option of interacting with us via personalized chat or video calls, where we can highlight and recommend products that best meet a visitor’s expectations and preferences. This use will also be associated with the tracking of SWAROVSKI Club Members´ experience on the Sites (including live tracking of their navigation on the Sites or mobile application) to allow SWAROVSKI to assist SWAROVSKI Club Members while navigating on www.swarovski.com.
Our chat feature involves the use of an automated response service (i.e., a “bot”) as well as connecting with a live customer service representative. We use a third party provider for this chat feature, so your information will be recorded and processed by this provider.
SWAROVSKI also saves data on SWAROVSKI Club Members’ purchase history in the form of items purchased (product designation, price, discount), place and time of purchase and membership number. The purchase history is recorded if the SWAROVSKI Club membership number is communicated at the checkout for purchases in stores participating in the SWAROVSKI Club program. In the online store Members’ purchase history is recorded if the membership number is quoted when making a purchase or if the Member makes a purchase when logged into an online account associated with a SWAROVSKI Club membership.
By voluntarily providing your Personal Information to SWAROVSKI through our Sites, stores, Loyalty Programs, or other products and/or services, you, give consent to SWAROVSKI to collect, hold, disclose, and use your Personal Information for the purposes for which you provided it and as otherwise set forth in this Privacy Policy. If you choose not to provide information, we may not be able to provide you with the requested products, services or information. If you provide us with Personal Information of other persons (for example, information about the receiver of a gift, or a referral), please provide their Personal Information to us only if you are allowed to do so pursuant to applicable data protection laws and only if the other person would agree to your providing Personal Information to us for the purposes for which the information is collected and processed according to this Privacy Policy.
We and our service providers may automatically collect and process certain Personal Information from and about you when you access our Sites or services or visit our stores. Examples of information we may collect include, but are not limited to: pages you visit, ads you click on, type of browser/device/hardware, address of mobile devices, smartphones or computers, IP based geographic location, search terms, and information from cookies, web beacons, pixels, hashed or pseudonymized email address and other tracking technologies deployed on our Sites.
This information helps us recognize you as a customer to create a customized experience, enables customers to purchase SWAROVSKI products, allows us to conduct market research with the goal of improving our Sites and product range, keeps customers informed about SWAROVSKI’s market activities, and allows us to better delegate repairs or other logistical tasks to third parties. We may also use automated collection technologies for reporting and analysis purposes, such as your shopping history on our Sites or in our stores, the performance of our marketing efforts and your response to those marketing efforts, and as otherwise required to provide the best possible customer experience for you. To draw inferences about you, we may connect information collected automatically with information we already have about you in order to identify you as a SWAROVSKI customer or Loyalty Program member. For example, we may collect information about you from other third parties, including demographic information, and combine this information with other information we collect about you. If we are able to identify you as a SWAROVSKI customer we may, for example, link your activity on our Sites to your Loyalty Programs or SWAROVSKI account. This allows us to provide you with a more personalized experience regardless of how you interact with us – online or in store.
In addition, our Sites may also utilize “session replay” technology for the purposes of detecting errors occurring on our Sites that may impact your experience. Such tracking includes recorded sessions, which we may play back for these purposes. We collect this data, via our service providers, which may change from time-to-time, who will use the data on our behalf and for this purpose. The data collected for this purpose does not include any information entered in forms such as your name, the delivery address or the credit card data, as these inputs are being masked out in session videos. You may withdraw your consent to these “session replay” technologies, that are not necessary for the technical performance of the Site, at any time by disabling cookies and other tracking technologies – please see the “About cookies and tracking technologies” section under “Cookies and Tracking Technologies” below.
SWAROVSKI uses cookies, pixels, tags, and similar tracking technologies to personalize the Sites and to help make the Sites more user-friendly, efficient, and secure. This Cookies and Tracking Technologies section provides you with information on the use of these technologies on the Sites. These technologies may be offered by third parties, are stored on your device, and used by your browser.

To help protect your submissions via internet forms on our Sites we use the reCAPTCHA service provided by Google Inc. (Google). The service determines whether the query was made by a human being or was the result of misuse, processed automatically by a computer. The service includes sending the IP address to Google and possibly other data if required by Google for reCAPTCHA. For this purpose, your entry is sent and used by Google. This data collection is subject to the data protection regulations of Google (Google, Inc.). We may use Google Analytics or similar services on our Sites to provide analytics services. These applications are third party services which allow SWAROVSKI to measure and analyze the use of its Sites. These entities may use cookies, pixels, web beacons, and other technologies to collect information about your use of our Sites, such as your IP address, web browser, pages viewed, time spent on pages, links clicked and conversion information. This information may be used by us and others to, among other things, analyze and track data, determine the popularity of certain content, and better understand your online activity. These service providers use persistent cookies / technologies for these applications. The service provider may know the identity of a user who has registered with the service provider. The service provider may monitor the use of the Sites by the user and combine this data with data from other websites monitored by the same service provider which the user has visited and the service provider may use these findings for its own benefits (e.g. control of advertisement). In this case the processing of the data will be the service provider's responsibility and data will be processed pursuant to the data protection policies of the service provider. We may also work with third parties to serve advertisements on our behalf to you across the Internet as part of a customized campaign on other websites or platforms. We may work with companies such as Google, Meta, Criteo, and Snapchat who use cookies, pixels, tracking technologies, hashed or pseudonymized email addresses and/or device identifiers to serve ads based on past visits to our Site and data they may hold based on the interaction with their products in accordance with their privacy policies to assist with advertising related to our Sites.
SWAROVSKI works with these third parties who process data retrieved from your device via cookies, pixels and/or device identifiers, and other tracking technologies, and hashed or pseudonymized email addresses transmitted by us, with consent, for the purpose of identification on third-party sites, of delivering and measuring our advertising as well as for its own and third parties´ purposes which may include, for example, inferences, insights into target groups and product developments. This allows SWAROVSKI to place targeted advertisements for these individuals on external third party websites (e.g. in connection with products for which these individuals showed an interest in the online-shop). The companies owning these websites and platforms have their own privacy policies in place, and SWAROVSKI’s privacy policy does not extend to the processing activities carried out by these partners where the latter are acting on their own account. For these purposes, the TTD´s technology (hereafter also “TTD Platform”) collects and processes certain data such as hashed or pseudonymized data about users, devices and ads, as well as where they are shown. The processed data includes: Cookie ID, Mobile Device ID, IP address, interest information, web browser and device information, information about which advertisements you have already seen, how you responded to ads, location information, timestamps and website URLs. We may also work with TTD to use a tool called Unified ID 2.0 (UID2) for the purposes described above. A UID2 is created by generating hashed or encrypted identifiers based on a user’s email address and/or phone number. UID2 is designed to enable companies to gather and combine data across different sites, apps, and other contexts, to share data to facilitate the buying and selling of advertising online (including targeted advertising), and to measure the results of advertising. Our data processing for the purposes of targeted advertising is carried out based on your consent. You can revoke your consent at any time with effect for the future by filling out a form by clicking on the “Your Privacy Choices” link at the bottom of our Sites and disable cookies and other technologies by saving your acceptance or rejection preferences in the “About cookies and tracking technologies” pop up banner which appears when you enter our Sites, or navigate to the “Cookie Consent” link at the bottom of our Sites.
You may also go to http://www.adsrvr.org/ to opt-out of the Trade Desk services. In this case, the so-called opt-out setting is designed to mean that you will no longer be shown targeted advertising across TTD customers / partners. We also allow users to generate content that may be posted on these social networks, such as through our “Wear it, share it” feature. These features on our Site use third party cookies or similar technologies. Therefore, if you accept all cookies and similar technologies, third party providers will track your interactions between and/or on our Site and the social networks, such as the number of impressions of your content and other metrics.
Please be aware that third-party websites and applications have privacy policies that differ from this Privacy Policy. If you choose to access our Sites from or in a third-party website or application (for example, Facebook, Twitter, Tik Tok, Instagram, or Google) “in-app”, such third parties may collect information about your activity on our Sites and how you use our Sites. This information collected by such third parties may be used to provide services like measurement services or to target ads. When accessing our Sites via a third-party website or applications “in-app” we recommend that you review the privacy policy or privacy notice/statement posted on the third party website or application before disclosing any personal information. Please contact those third parties directly if you have any questions about their privacy policies or if you wish to opt-out of the collection and use of your information for targeted advertising or other purposes by such third parties based on information about your activity on nonaffiliated applications and websites.
We have no control over the privacy practices of websites, applications or social media platforms that we do not own. Their use of your information is not governed by this Privacy Policy.
- Store Cameras and Video Surveillance
We use automated collection technologies to share information with third parties, such as Riskified, to help us prevent fraud or other harmful activities. Additionally, we may share information with Riskified, which may include, for example, name, email address, phone number, IP address, IP location data, billing and shipping names and addresses, and other transactional information. Your transactions on our Sites may be automatically accepted or declined based on data analysis performed by these services. SWAROVSKI does not use your Personal Information for profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
In addition to the use cases set forth in this Privacy Policy, we share the information we collect within SWAROVSKI, which includes all SWAROVSKI affiliates. For example, we may share your information with our subsidiaries and affiliated companies or brands to administer our Loyalty Programs and customer accounts, process orders and requests, and expand and promote our product and service offerings. We may share the information we collect with a SWAROVSKI affiliate for the purposes of operating the Loyalty Programs in cases where you join a Loyalty Program in a country/region different from your country/region of residence or to determine your Loyalty Club rewards based on your purchases in countries or regions different from your country/region of residence. SWAROVSKI is part of a global group of companies and affiliates, and information collected about you may be shared, processed or stored anywhere we engage service providers, including outside the United States. By using our Sites and services, you consent to the transfer of information to countries outside your country of residence.
We may also provide your information to our service providers as necessary to enable them to perform certain services for us, including, but not limited to: email-providers, mobile marketing providers, analytics providers, web hosting providers, sweepstakes vendors, payment processors, coupon delivery providers, fraud prevention providers, or shipping services providers. We may also provide your information to third parties including social media and marketing partners for the purposes of providing personalized marketing content as well as of optimizing marketing and communication strategy, as more fully described in Section IV.B. “Advertising Services”.
We may also disclose specific information when such disclosure appears necessary to comply with the law, a subpoena or other litigation process, or to protect the interests or safety of SWAROVSKI or of our visitors and customers, employees, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
In the event that a store, division, asset, or part or all of SWAROVSKI is bought, sold or otherwise transferred, or is in the process of a potential transaction or bankruptcy/reorganization, customer information may be shared for evaluation purposes, and included among the transferred business assets.
We may share aggregate or anonymized data derived from information we collect with advertisers and other third parties. As noted above, such aggregate or anonymized data does not constitute Personal Information.
In any circumstance other than those described in this Privacy Policy, we will ask for your consent before we share your Personal Information outside of our corporate family of companies.
We use your information to provide our services and to better enhance your customer experience. In addition to the other examples given in this Section IV, we may use your information:
- in connection with the services offered on our Sites or to fulfill and manage purchases, orders, payments, and returns/exchanges;
- to manage, maintain, and enhance our Sites, Loyalty Programs, customer accounts, and newsletter;
- to respond to requests for information about our products and services in our stores or on our Sites, and to provide non-marketing information concerning matters such as changes to our Privacy Policy or Terms and Conditions and/or Terms of Use, changes to product and service offerings, account verification, password reset, or incidents that could affect our products or services;
- to deliver personalized coupons, invitations to events, vouchers, discount and other offers, newsletters, in-store promotional activities, emails, mobile messages, social media notifications, surveys, and marketing related materials;
- to connect with you regarding customer service activities;
- to administer sweepstakes, contests, or other promotional activities;
- to assist law enforcement, investigate security breaches, and to respond to regulatory or other legal inquiries;
- to support a contemplated or actual corporate transaction such as reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets or stock (including with any bankruptcy or similar proceedings);
- for our other internal business purposes, designed to improve and enhance your customer experience.
SWAROVSKI may also use Personal Information of Loyalty Programs members to:
- Administer their memberships;
- Operate of the Loyalty Programs, namely providing of advantages and awarding special conditions (e.g. vouchers), invitations to special events and promotions reserved for members;
- Participation in surveys, requiring customer feedback across channels (SWAROVSKI stores, swarovski.com, e-mail, social media);
- Provision of relevant information and personalized / targeted marketing content;
- Provision of personalized offers, assistance and advice regarding products and services;
- Optimization of SWAROVSKI´s marketing and communication strategy;
- Provision of invitations to special events and promotions reserved for registered customers;
- Non-marketing communication including but not limited to: changes related to our Privacy Policy, General Terms and Conditions and/or Terms of Use; general changes to product and service offering; account verification; password reset; or an information related to incidents that could affect our services.
SWAROVSKI may also use Personal Information of Loyalty Program members to propose them personalized assistance and advice and to be in contact with a dedicated Crystal Expert with any requests they may have via phone, email or in any other way chosen by SWAROVSKI. Members can decide if they wish to benefit from such services. For the provision of this personalized assistance of interest to Loyalty Programs members, SWAROVSKI use automated processing of Personal Information to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict elements such as preferences, interests or likely behavior of that natural person. We may display targeted ads to you through social media platforms. These ads are sent to groups of people who share traits such as likely commercial interests and demographics. For example, we may target customers who have expressed an interest in shopping for necklaces, watches, etc. See Section IV.B. “Advertising Services” above.
By providing certain information to SWAROVSKI, such as a residential or mobile telephone number, Loyalty Programs members are consenting to and authorizing SWAROVSKI and its affiliates, to contact them from time to time by telephone at the telephone number provided (even if their phone number(s) may be on a Do-Not-Call list) to receive personalized marketing and non-marketing calls from or on behalf of SWAROVSKI. Further information regarding our customer Loyalty Programs can be found in the General Terms and Conditions of the customer Loyalty Programs on www.swarovski.com.
Any consent can be withdrawn at any time by contacting SWAROVSKI using one of three methods: (1) call +1 800-426-3088; (2) submit a request at us.privacy@swarovski.com; (3) submit a request at one of our retail locations; or (4) for opting out of targeted advertising, fill out the form by clicking on the “Your Privacy Choices” link at the bottom of the Sites and disable cookies by saving your acceptance or rejection preferences in the “About cookies and tracking technologies” pop up banner which appears when you enter our Sites, or navigate to the “Cookie Consent” link at the bottom of our Sites. If you successfully submit the “Your Privacy Choices” form linked at the bottom of the sites, your consent for these non-essential cookies and other tracking technologies will automatically be withdrawn from the device and browser you are on. If you would like to verify this, please click the “About cookies and tracking technologies” banner located at the bottom of the Swarovski.com homepage or the “Cookie Consent” link located at the bottom of the Swarovski.com on this device and browser after submitting the form. Please note disabling, accepting, or rejecting cookies is browser and device specific. You must also separately revoke your consent to these non-essential cookies and other tracking technologies on any different browsers or mobile devices you use.
Even after you opt-out or update your marketing preferences with us, we may still contact you for transactional or informational purposes. These include, for example, customer service issues, returns or product-related inquiries, surveys or recalls, or any questions regarding a specific order.
Residents of certain States have additional rights as detailed in Sections VI, VII VIII and IX.
SWAROVSKI receives and processes GPC Signals for requests to opt-out of sale or sharing. We will process the GPC Signal as a request to opt you out of the selling or sharing of any personal information that is activated and sent through your specific web browser to the extent required by applicable law.
If you registered your contact details through an online account, you may view and modify, correct, block or delete your data -- including managing your registration for the Newsletter, as described below -- at any time by selecting Profile in the “My Account” area of the Sites.
You can conveniently manage your registration for the SWAROVSKI Newsletter in the "My Account" area of the Sites. Simply enter your e-mail address in the field provided and then click "send". We will send a confirmation e-mail to the e-mail address you give us.
SWAROVSKI is concerned about the privacy and safety of children when they use the Internet. We do not knowingly collect any Personal Information from children under the age of 18. You have the right to request that we delete any Personal Information about and collected from you, and that we direct any service provider to delete such Personal Information from its records. We estimate the value of the Personal Information collected through the financial incentive program described above to be $3.68 per consumer. This good-faith estimate is based on expenses related to the collection and retention of such data, per California Attorney General Regulation Section 999.337(a)(5). These expenses include the cost of technology and personnel used to collect and retain the Personal Information. We believe that the financial incentives are reasonably related to the value of the Personal Information because we have learned from experience that the expenses are required to collect and retain that information as part of the financial incentive program, and the financial incentive program helps increase consumer sales and revenue.
In general, SWAROVSKI retains Personal Information for no longer than is necessary for the purposes for which the Personal Information is processed. Please note that for legal, accounting, and other legitimate business purposes, we will retain certain Personal Information in our archives with strictly limited access. SWAROVSKI may retain Personal Information for longer periods subject to the following rules and obligations: SWAROVSKI retains Personal Information as long as SWAROVSKI (i) is obligated to do so (by way of contract, law, or other provisions) or (ii) has an overriding interest (e.g. an interest for reasons of proof in case of claims, documentation of compliance with certain legal or other requirements). Hashed or pseudonymized Personal Information may be retained for longer periods of time, subject to applicable law.
For contract related Personal Information (e.g. your receipt / invoice when you purchase a product from us) SWAROVSKI retains personal data as long as the contractual relation is ongoing and for 10 years after the termination of the contractual relationship unless (i) a shorter or longer storage obligation is applicable on a case-by-case basis if required by applicable law, (ii) the retention is required for reasons of proof or another valid reason based on applicable law, or (iii) the deletion of the data is required earlier (because e.g. the data is no longer required or SWAROVSKI is required to delete the respective data).
For operational data containing Personal Information (e.g. customer service logs when you contact us), SWAROVSKI retains Personal Information for a period of 3 - 12 months.
With respect to Loyalty Programs, Personal Information will be held and used for the duration of the Membership; thereafter, it will be retained for no more than 5 years, unless required for legal reasons. The purchase history is generally recorded for 5 years. As exception to this rule, the purchase history on SWAROVSKI Crystal Society exclusive products will be kept during the entire duration of the Membership in order to recognize member life-time value to the SWAROVSKI Crystal Society.
