GENERAL TERMS AND CONDITIONS

1. Eligibility

User Generated Content can be created and shared with (by tagging)/ uploaded to the Website (the “Website”) by anyone who: a) is at least 18 years of age (or at least the age of majority in the country of residence); and b) did not purchase any equipment for the purposes of using the Website.

2. Owner of the Website

Swarovski Crystal Online AG, Alte Landstrasse 411, 8708 Männedorf, Switzerland, ("Owner") on behalf of Swarovski Aktiengesellschaft, Dröschistrasse 15, 9495 Triesen, Fürstentum Liechtenstein.

Using the Website constitutes User’s full and unconditional agreement to these Terms and Conditions and Owner’s decisions, which are final and binding in all matters related to this Website.

As a registered Instagram Account holder, Users must upload and tag an image/images (“Image”) with “#Swarovski” to share it with the Owner/on the Owner’s Website.

Via Twitter: Tagging User Generated Content on Twitter includes holding a separate Twitter account. Registered Twitter Account holders must agree to the Twitter Terms of Service (a copy of which can be found at https://twitter.com/tos) and the Twitter Privacy Policy (a copy of which can be found at https://twitter.com/privacy).

As a registered Twitter Account holder, Users must upload and tag an image/images (“Image”) with “#Swarovski” to share it with the Owner/on the Owner’s Website.

Via Tumblr: Tagging User Generated Content on Tumblr includes holding a separate Tumblr account. Registered Tumblr Account holders must agree to the Tumblr Terms of Service (a copy of which can be found at https://www.tumblr.com/policy/en/terms-of-service) and the Tumblr Privacy Policy (a copy of which can be found at https://www.tumblr.com/policy/en/privacy).

As a registered Tumblr Account holder, Users must upload and tag an image/images (“Image”) with “#Swarovski” to share it with the Owner/on the Owner’s Website.

4.2. On the Website:

There are the following possibilities to upload User Generated Content on the Website:

Via Website Application: To upload User Generated Content on the Website, the User must follow the instructions given on the Website. In addition, the User must provide certain information if requested. User may provide only true, complete and current information.

The User ID gives the User access to the personal Website Account. User may not allow anyone else to access or use their personal Account or User ID. User is responsible for all activities that occur under it’s personal Account or User ID.

User’s information submitted to the Owner via the website will be treated in accordance with owner’s Privacy Policy, which can be found at www.swarovski.com/dataprotection.

Via Facebook: Uploading User Generated Content via Facebook includes holding a separate Facebook account. Registered Facebook Account holders must agree to the Facebook Terms

Users must register for a Facebook personal account. Creating a Facebook personal account is free of charge and can be done by visiting www.facebook.com. To create a Facebook account, Users must agree to the Facebook Terms and Conditions (a copy of which can be found at http://www.facebook.com/legal/terms) and the Facebook Privacy Policy (a copy of which can be found at https://www.facebook.com/privacy/explanation).

5. Directrices de Contenido

Directrices de Contenido. Las Imágenes no podrán:

Contener material que contravenga o infrinja los derechos de terceras partes —incluidos, sin limitación, los derechos de privacidad, de publicidad o de propiedad intelectual— o que constituya una infracción de los derechos de autor;

Denigrar al Propietario o a cualquier otra persona o parte;

Contener nombres de marcas o marcas comerciales que no sean propiedad del Propietario, para los que el Usuario dispone de una licencia limitada de uso con fines de incorporación de su Imagen;

Contener imágenes, música, ilustraciones u otro material con derechos de autor no creado por el Usuario;

Contener material indecente, obsceno, desagradable, agraviante, difamatorio, calumnioso o maldiciente (incluyendo, sin limitación, representaciones de desnudez, actividad sexual, imágenes o lenguaje ofensivo u otras conductas o actividades obscenas);

Contener material inadecuado para el Sitio Web (lo que incluye, sin limitación, representaciones de signos/símbolos de grupos o bandas, armas, violencia, amenazas de violencia, alcohol, drogas u otros comportamientos o actividades inapropiados);

Contener material que promueva intolerancia, racismo, odio o daño contra cualquier individuo o grupo, así como la discriminación basada en raza, sexo, religión, nacionalidad, discapacidad, orientación sexual o edad;

Representar el consumo de alcohol, ya sea con moderación o no;

Si se le solicitara, el Usuario deberá poder proporcionar esos permisos en un formato que el Propietario considere aceptable.

6. Derechos de Propiedad Intelectual

Para todos los Usuarios: SIN PERJUICIO DE LA GENERALIDAD DE ESTAS NORMAS OFICIALES, EL USUARIO CONVIENE OTORGAR, TRANSFERIR, TRANSMITIR Y CEDER AL PROPIETARIO DE MANERA IRREVOCABLE LA TOTALIDAD DE LOS DERECHOS INHERENTES A CUALQUIER CARGA DE CONTENIDO GENERADO POR EL USUARIO, CUALESQUIERA OBRAS DERIVADAS DE ESTE Y TODAS LAS RENOVACIONES Y AMPLIACIONES DE LOS DERECHOS DE AUTOR DE DICHAS OBRAS (INCLUIDO EL DERECHO A GARANTIZAR EL REGISTRO DE SUS DERECHOS DE AUTOR) A PERPETUIDAD (O DURANTE EL MÁXIMO PERIODO DE TIEMPO QUE PERMITA LA LEY, PERO EN NINGÚN CASO POR UN PERIODO INFERIOR A DIEZ [10] AÑOS) INCLUIDOS, SIN LIMITACIÓN, LOS DERECHOS PARA UTILIZAR EL CONTENIDO GENERADO POR EL USUARIO PARA CUALQUIER FIN Y EN TODOS Y CUALQUIERA DE LOS MEDIOS CONOCIDOS O DESARROLLADOS EN EL FUTURO, EN TODO EL MUNDO. AL CARGAR CONTENIDO GENERADO POR EL USUARIO EN EL SITIO WEB, EL USUARIO RENUNCIA ASIMISMO —Y EN LA MEDIDA EN QUE LA LEY LO PERMITA— A TODOS LOS DERECHOS MORALES INHERENTES AL USUARIO O QUE PUDIERAN DERIVARSE DEL CONTENIDO GENERADO POR EL USUARIO EN CUESTIÓN EN CUALQUIER PARTE DEL MUNDO. El Usuario conviene asimismo ayudar al Propietario en cualesquiera trámites de expedientes, registros u otros documentos que fueran necesarios para completar y concluir debidamente la cesión y transferencia de los derechos. En caso de que el Usuario no pudiera transferir y ceder los derechos del Contenido Generado por el Usuario según se estipula en esta Sección, el Usuario concedería al Propietario el derecho y licencia no exclusivos, libres de regalías, irrevocables, perpetuos (o, si la ley no permitiese la concesión a perpetuidad, durante el máximo periodo permitido por esta, pero en ningún caso por un periodo inferior a diez [10] años) y de ámbito mundial para mostrar, ejecutar, modificar, adaptar, reproducir, codificar, almacenar, copiar, transmitir, publicar, enviar, divulgar, exhibir o utilizar de cualquier otro modo (sin limitación en cuanto al momento o al número de veces de uso) el Contenido Generado por el Usuario, en su totalidad o en parte, así como cualesquiera obras derivadas de este, para cualquier fin, incluidos fines promocionales o de marketing, salvo en los casos en que la ley lo prohíba.

7. Publicidad

Salvo cuando esté prohibido, la carga de Contenido Generado por el Usuario implica el consentimiento del Usuario para que el Propietario y sus representantes puedan utilizar el nombre, la imagen, las fotografías, la voz, las opiniones o la ciudad natal y el estado o provincia del Usuario para fines promocionales en cualquier medio de todo el mundo, sin recibir ningún pago adicional ni contraprestación.

8. Garantías y Representaciones

AL CARGAR CONTENIDO GENERADO POR EL USUARIO, CADA USUARIO GARANTIZA Y ASEGURA QUE: (a) EL USUARIO POSEE TODOS LOS DERECHOS DEL CONTENIDO GENERADO POR EL USUARIO, INCLUIDOS, SIN LIMITACIÓN, LA IMAGEN Y EL RENDIMIENTO DE CADA CONTENIDO GENERADO POR EL USUARIO; (b) EL USUARIO ES EL INDIVIDUO QUE APARECE REPRESENTADO EN EL CONTENIDO GENERADO POR EL USUARIO, O, DE NO SER ASÍ, EL USUARIO HA OBTENIDO EL PERMISO DE TODAS Y CADA UNA DE LAS PERSONAS QUE APARECEN EN EL CONTENIDO GENERADO POR EL USUARIO PARA CONCEDER LOS DERECHOS AL PROPIETARIO DESCRITO EN ESTAS NORMAS, Y ESTÁ EN DISPOSICIÓN DE FACILITAR LAS COPIAS DE DICHOS PERMISOS AL PROPIETARIO SI ESTE LAS SOLICITARA; (c) EL CONTENIDO GENERADO POR EL USUARIO SE HA OBTENIDO Y CREADO POR MEDIOS LEGALES; (d) EL CONTENIDO GENERADO POR EL USUARIO NO INFRINGE LOS DERECHOS DE PROPIEDAD INTELECTUAL, PRIVACIDAD O PUBLICIDAD, NI NINGÚN OTRO DERECHO LEGAL O MORAL DE TERCEROS; Y QUE (e) EL CONTENIDO GENERADO POR EL USUARIO NO INFRINGE NINGUNA LEY O NORMATIVA QUE SEAN DE APLICACIÓN. El Usuario indemnizar al Propietario, a las Partes Exoneradas (definidas en la Sección 9 siguiente) y a cualquier licenciatario del Propietario por cualesquiera demandas, daños, responsabilidades y gastos (incluidos los honorarios por asesoramiento jurídico y costas judiciales) derivados del incumplimiento de cualquiera de estas cláusulas.

9. Exoneración

Al cargar Contenido Generado por el Usuario en el Sitio Web, el Usuario se compromete a liberar de responsabilidad al Propietario y a las Plataformas de Redes Sociales descritas en el apartado 4 anterior y a sus respectivas filiales, asociados, proveedores, distribuidores, agencias de publicidad/promoción y a cada una de sus respectivas compañías matrices y sus responsables, directores, empleados y agentes (en lo sucesivo y en conjunto, las “Partes Exoneradas”) de cualquier reclamación o demanda, incluidas, sin limitación, aquella por lesiones personales, fallecimiento, o daños o pérdida de propiedad derivados del acceso al Sitio Web en la máxima medida en que la ley lo permita. Asimismo, el Propietario se reserva el derecho de —a su entera discreción— suspender o eliminar cualquier Contenido Generado por el Usuario que considere que: a) manipule los procesos de acceso o el funcionamiento del Sitio Web; b) infrinja estas Normas Oficiales o las de cualquier otra promoción; c) dé indicios de una conducta antideportiva o desleal; o d) sea inapropiado para el Sitio Web. Cualquier intento por parte de cualquier persona de socavar deliberadamente el legítimo funcionamiento del Sitio Web podría constituir una infracción del Código Civil o Penal y, de realizarse tal intento, el Propietario se reserva el derecho a reclamar daños y perjuicios, así como otras compensaciones (incluidos los honorarios de abogados) a dicha persona en la máxima medida en que los permita la ley. La omisión del Propietario de hacer cumplir cualquier cláusula de estas Normas Oficiales no deberá interpretarse en ningún caso como una renuncia a tal disposición.

11. Limitaciones de la Responsabilidad

Las Partes Exoneradas no serán responsables por: (1) cualquier información incorrecta o inexacta, ya sea causada por errores del Usuario o por errores de impresión, tipográficos o de otra índole, o por cualquier equipo o programación relacionados o utilizados en el Sitio Web; (2) averías técnicas de cualquier tipo, incluidos —sin limitación— fallos en el funcionamiento, interrupciones o desconexiones de las líneas telefónicas o del hardware o software de red; (3) intervención humana no autorizada en cualquier parte del proceso de acceso al Sitio Web; (4) errores de impresión, tipográficos, técnicos, informáticos, de red o humanos que pudieran producirse durante la administración del Sitio Web, durante la carga o en cualquier material relacionado con el Sitio Web; (5) correo y Contenido demorados, extraviados, no entregados, dañados o sustraídos; o (6) cualquier lesión o daños personales o materiales que pudieran derivarse, directa o indirectamente, en su totalidad o en parte, del acceso del Usuario al Sitio Web. 12. Conflictos

To the fullest extent permitted by applicable law, User agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with the User Generated Content or the Website shall be resolved individually, without resort to any form of class action, and exclusively by Swiss courts located in Zurich, Switzerland; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with accessing the Website or the upload of User Generated Content, but in no event attorneys’ fees; and (3) under no circumstances will User be permitted to obtain awards for, and User hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the User and Owner in connection with the Website or the upload of User Generated Content, shall be governed by, and construed in accordance with, the laws of the Canton of Zurich, Switzerland without giving effect to any choice of law or conflict of law rules (whether of the Canton of Zurich, Switzerland or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Canton of Zurich, Switzerland.

13. User’s Personal Information

All information will be submitted directly to the Owner via the Website. All information submitted to Owner will be treated in accordance with Owner’s Privacy Policy, available at http://www.swarovski.com/dataprotection

Information submitted via Social Media Platform is subject to the respective Social Media Platform’s privacy policy as set out in Para 4 hereinabove. The User’s personal information will be used for any purposes consistent with these Terms and Conditions. The User’s country of residence may grant the right to review and correct the personal data stored about the User, including its origin, recipient or categories of recipients of the data and the purpose of the storage. In addition, the User may have the right to disable and delete its data, depending upon the circumstances. If the User’s country of residence grants such rights, the User may exercise them by making its request in writing. 14. Consumer Rights

Nothing in these Official Rules shall be deemed to exclude or restrict any of the User’s statutory rights as a consumer.
