Swarovski Created Diamonds Upgrade Program Terms & Conditions
Title:1. APPLICABILITY
These Upgrade Program Terms & Conditions (hereinafter referred to as ‘Upgrade Program T&Cs’) apply exclusively to all upgrade requests of Swarovski Created Diamonds jewelry purchased within India directly from Swarovski boutiques, via the official Swarovski India website at www.swarovski.com/en-IN, or from authorized Swarovski retailers in India, including authorized third-party online retailers (hereinafter collectively referred to as ‘Swarovski’ / ‘We’ / ‘Us’ / ‘Our’). By participating in this Upgrade Program, you confirm that you have read, understood, and agreed to comply with these Upgrade Program T&Cs, in addition to the General Terms & Conditions, Privacy Policy, and any other applicable policies of Swarovski.
2. ELIGIBILITY
2.1. To be eligible for an upgrade under this program, all of the following criteria must be fulfilled:
- a) The Upgrade Program is strictly limited to Swarovski Created Diamonds jewelry items and does not extend to any other products or categories within the Swarovski assortment.
- b) The original purchase must have been made either directly from Swarovski or from an authorized Swarovski retailer in India.
- c) The upgrade request must be accompanied by the original purchase receipt, proof of purchase as registered in Our system, and the corresponding Swarovski Created Diamonds certificate of the original purchase. For further details on acceptable proof of purchase, please refer to our FAQs at Swarovski.com.
- d) The upgrade must be requested within ten (10) years from the date of original purchase, as evidenced by the original receipt.
- e) The original purchase product must be free from any damage, alterations or missing components and must specifically not have any lost, missing, scratched, cracked, or chipped diamonds Products showing physical damage, cracks, chips, or missing stones or parts, or unauthorized repairs or modifications will not be eligible.
2.2. Swarovski reserves the right to inspect and approve the original purchase product before confirming eligibility, and to reject any upgrade request that does not fully comply with the above requirements.
2.3. Products purchased outside India or from unauthorized sellers, and any promotional or discounted purchases (unless explicitly stated) are explicitly excluded from this Upgrade Program.
3.UPGRADE CONDITIONS
3.1. The trade-in value attributed to the original purchase product for the purposes of this Upgrade Program shall be eighty percent (80%) of its original invoiced value.
3.2. A credit note will be issued for this trade-in value and may be redeemed against any product(s) from the Swarovski collection (excluding products from Swarovski Creator’s Lab or co-branded or collaboration collections) of equal or higher value than the trade-in value (“Upgraded Item(s)”). No cash refunds or partial credits will be issued. The credit is non-transferable and valid only for a single transaction at the time of upgrade. You will pay for the difference (if any) between the trade-in value and the price of the Upgraded Item(s). If the Upgraded Item(s) is of lower value than the trade-in value, any credit remaining from the trade-in value shall be forfeited. All applicable taxes, duties, and charges on the new purchase will be borne by you. Pricing of the Upgraded Item(s) will follow the prevailing rates at the time of the upgrade.
3.3. For the avoidance of doubt, the Upgrade Program, including any trade-in value or benefit received thereunder, is strictly non-redeemable for cash or any monetary equivalent, in part or in whole. No cash or alternative compensation will be provided in lieu of an upgrade or in the event of a declined or unfulfilled upgrade request, or partial use of the trade-in value credit.
3.4. The Upgrade Program cannot be combined with any other promotional offers, discounts, or price reductions.
3.5. To benefit from the Upgrade Program, the Customer must personally visit a Swarovski boutique in India or the authorized Swarovski retailer where the purchase was made. Upgrades cannot be processed online via the Website or any digital channel, unless explicitly communicated otherwise by Swarovski. Please visit FAQ page on www.swarovski.com or contact the customer service team for the list of stores participating in the Swarovski Created Diamonds Upgrade Program. Upgrades must be processed and completed and the credit from the trade-in value must be used to purchase Upgraded Item(s) on the same day and at the same store.
3.6. All upgrade requests are subject to review and approval in Our sole discretion. Our decision on eligibility and valuation is final and binding.
3.7. In the event that Swarovski ceases to operate or distribute Swarovski Created Diamonds jewelry within the ten (10) year eligibility period, or if the brand or product line is no longer available for commercial sale, Swarovski shall not be held liable for the inability to fulfill the Upgrade Program. In such case, no monetary or alternative compensation shall be provided.
4. WARRANTY
4.1. The upgraded item received under this program shall benefit from a new warranty period commencing as of the date of receipt of the Upgraded Item by you.
4.2. The warranty period for the Upgraded Item shall be the standard warranty period offered by Swarovski for that product as detailed in Our Warranty Terms and Conditions.
4.3. All other warranty conditions, exclusions, and limitations as defined in Our Warranty Terms & Conditions shall apply without modification.
5. AMENDMENTS
We reserve the right to modify or terminate this Upgrade Program and/or these Upgrade Program T&Cs at any time in Our sole discretion, and to reject any request that does not comply with these Upgrade Program T&Cs.
Any such modifications shall be effective upon publication on the applicable Websites or upon notification via other suitable communication channels.
6. GOVERNING LAW
These Upgrade Program T&Cs are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in New Delhi, India.
