NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.  PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  THIS PROMOTION IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW. VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW.  

SPONSOR: The Swarovski Online Advent Calendar Promotion (the “Promotion”) is sponsored by Swarovski North America Limited, a Rhode Island corporation, with its principal place of business at One Kenney Drive, Cranston, Rhode Island 02920 (“Sponsor”).  

ELIGIBILITY: The Promotion is only open to legal residents of the fifty (50) United States and the District of Columbia who are at least 18 years of age or older as of the time of entry (each, an “Eligible Person(s)"). Employees (and their immediate families (parent, child, spouse, or sibling, and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of Sponsor, and its parent, Released Parties (defined below), subsidiaries, agents, or any other business involved with the administration of this Promotion are not eligible to enter or win. The Promotion is subject to these official rules (the “Official Rules”), and by entering, Eligible Persons agree to be bound by them and the decisions of Sponsor, which are final and binding on all matters relating to the Promotion.   

PROMOTION PERIOD: This Promotion begins on December 1, 2023, at 12:00:01 a.m. Eastern Standard Time (“EST”) and ends on December 24, 2023, at 11:59:59 p.m. EST (the “Promotion Period”).  There will be twenty-four (24) daily entry periods within the Promotion Period.  Each daily entry period begins at 12:00:01 a.m. EST and ends at 11:59:59 p.m. EST (each, an “Entry Period”).  Sponsor’s or its parent’s computer systems will be the official timekeeping device for the Promotion. Attempted entry before or after the Promotion Period will be disqualified.  

HOW TO ENTER: An Internet connection is required, and connection fees may apply. During each Entry Period, visit https://www.swarovski.com/en-US/s-swarovski-advent-calendar/ (the “Promotion Site”) and click where prompted to initiate participation in the Promotion by providing a valid e-mail address and by agreeing to these Official Rules (each such person upon initiation of participation being deemed an “Entrant”).  The Promotion consists of an interactive game formatted as a Christmas Advent calendar with twenty-four (24) virtual “doors” corresponding with each Entry Period within the Promotion Period.  There are two parts to the game.  The first part is an interactive quiz, memory-matching game, or similar game requiring skill (each a “Game”); the second, accessible only by those Entrants who are successful in the Game, is an instant-win game (the “Instant-Win Game”).  For each Game the Sponsor shall act as the judge for purposes of determining success in completion of a Game, and the judge’s decisions in this regard are final as to all such determinations.  Entrants can only access the Game and Instant-Win Game associated with the applicable Entry Period.  Entrants who have succeeded in completing a Game during the applicable Entry Period will then be prompted to participate in the Instant-Win Game for that Entry Period.  Successful completion of a Game in one Entry Period does not automatically qualify an Entrant to participate in an Instant-Win Game for any other Entry Period.  Entrants must successfully complete a Game in each Entry Period to play the Instant-Win Game for that Entry Period. Upon playing the Instant-Win Game, the interactive system will reveal whether the Entrant (a) is the potential winner of a Prize (as defined below); or (b) has not won a Prize but can try again in subsequent Entry Periods, if available. 

Limit: One (1) entry per Eligible Person, per e-mail address account per Entry Period. Entries over the maximum number of entries will be void. Entries that are incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive, or otherwise not in compliance with the Official Rules may be disqualified from the Promotion at Sponsor’s sole and absolute discretion. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified.  Entries received based on any tampering or otherwise not in compliance with these Official Rules will render that Eligible Person ineligible to receive any prize(s), and may result in Eligible Person no longer being allowed to enter during the remainder of the Promotion Period and/or Sponsor’s other promotions in the future, at Sponsor’s sole discretion. Subsequent attempts made by the same individual to submit multiple entries by using multiple or false contact information or otherwise in violation of these Official Rules may be disqualified. Eligible Persons must have a valid e-mail address. Those who do not follow all of the instructions, provide the required information, or abide by these Official Rules or other instructions of Sponsor may be disqualified.  In the event of a dispute as to any entry, the Authorized Account Holder of the e-mail address used to register for participation will be deemed the Eligible Person or Entrant.  The “Authorized Account Holder” is the natural person who is assigned an account by the Internet access provider, online service provider, or other organization responsible for assigning such accounts or the account associated with the submitted e-mail address. The potential winners may be required to show proof of being the Authorized Account Holder.  

VALIDATION:  All potential winning plays are subject to verification by Sponsor or its parent, whose decisions are final and binding.  An Entrant is not a winner of any prize, even if the Instant-Win Game should so indicate, unless and until Entrant’s eligibility and the potential winning play have been verified and Entrant has been notified that verification is complete.  Sponsor will not accept screen shots or other evidence of winning in lieu of its validation process.  Any play that occurs after the system has failed for any reason is deemed a defective play, is void, and will not be honored. 

WINNER SELECTION IN INSTANT-WIN GAME: Entrants will be notified instantly whether they have potentially won a Prize (as described below) upon opening a “door” on the advent calendar.  There will be Forty-four (44) pre-determined, winning times during the Promotion Period. The seeding of prizes associated with the winning times will be pre-determined in Sponsor’s sole discretion. The first Entrant to play the Instant-Win Game at or after one of the pre-determined times will be a potential instant winner of the prize indicated. 

ODDS OF WINNING: Odds of winning an Instant-Win Game prize depend on the number of prizes available for the prize type per Entry Period divided by the number of eligible entries during an Entry Period.

One-year SCS Membership will be awarded in the shape of a form wherein a verified winner can sign up or renew an existing membership; potential winner would need to consent to the General Terms & Conditions of the SCS, as well as the SCS’s Privacy Policy in order to redeem the membership. The ARV is subject to change based upon current market conditions at the time of Prize fulfillment. Any difference between the ARV and the actual value, if any, will not be awarded.  If for any reason a Prize is unavailable, Sponsor reserves the right to award a substitute Prize of comparable or greater value as set forth in these Official Rules in its sole discretion.  No substitution, transfer, assignment or cash equivalent of a Prize, or any portion thereof, is permitted by a winner. All federal, state, and local tax liability, and any other costs and expenses associated with acceptance or use of a Prize not specifically provided for in these Official Rules are solely the winner’s responsibility. The winners are each responsible for all applicable federal, state, and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. Allow 4-6 weeks for shipment of Prize.   

WINNER VERIFICATION:  Within five (5) business days of the Sponsor’s notification that an Entrant has been validated as a potential winner of a Prize, Entrant will be required to supply Sponsor with any requested information for the administration of the Promotion (e.g., delivery mailing address) , and Entrant may be required to sing and return, via email, a Declaration of Eligibility and Release and Waiver of Liability, and where legal, a Publicity Release. A potential prize winner becomes an actual prize winner only after verification of eligibility by Sponsor and Sponsor’s receipt of a Declaration of Eligibility and Release and Waiver of Liability, and a Publicity Release, except where prohibited. If a potential winner cannot be contacted, is ineligible as determined by Sponsor, fails to comply with these Official Rules, fails to respond to the notification within the required time period, fails to provide the requested information, fails to comply with the Sponsor’s instructions, or if the notification is returned as undeliverable, the potential winner forfeits the applicable Prize. Sponsor is not responsible for any change of e-mail address or other contact information of potential winner.  The Released Parties (defined below) are not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify the potential winners.  By accepting a Prize, the winner consents to the use of their name and likeness for advertising and promotional purposes without additional compensation, except where prohibited by law. Any Prizes not claimed by January 31, 2024, will not be awarded.  

RELEASE: Participant agrees to release and hold harmless Sponsor, its parent, subsidiaries, agents, or any other business involved with the administration of this Promotion and each of their respective parent companies and each such company’s officers, directors, employees, agents, and their advertising and promotional agencies or marketing partners and prize suppliers; each of their respective officers, directors, agents, representatives and employees; and each of these companies’ and individuals’ respective successors, representatives, and assigns (collectively, the “Released Parties”) from and against: (a) any claim, liability, or cause of action, including, but not limited to, damage to or loss of property, arising out of participation in the Promotion, receipt or use or misuse of any Prize, or any breach of these Official Rules; and (b) any claim including claims based upon defamation, publicity rights, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property-related cause of action arising from or related to the Promotion, the Prizes, or Sponsor’s  advertising and marketing related to the Promotion, Entrants, or the winners.  Winning a Prize or receiving a discount/free gift offer is contingent upon fulfilling all requirements set forth herein. 

The Released Parties assume no responsibility for and will disqualify entries that are: stolen, late, lost, illegible, incomplete, invalid, unintelligible, altered, tampered with, unauthorized, fraudulent, damaged, destroyed, delayed, misdirected, not delivered, not received, or that have incorrect or inaccurate entry information, whether caused by any of the equipment or programming associated with or utilized in promotions, or by any human, mechanical or electronic error that may occur in the processing of the entries in promotions, or other errors appearing within the Official Rules or in any Promotion related advertisements.  Use of any device to automate or subvert entry is prohibited and any entries received by such means will be void.  Sponsor reserves the right in its sole discretion to disqualify any Eligible Person it suspects or finds: (i) to have tampered with the entry process or the operation of the Promotion; (ii) to be acting in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; (iii) to display behavior that will bring such Eligible Person or the Released Parties into disgrace (e.g., including but not limited to, a person committing acts of moral turpitude, and/or allegations or convictions of any crime); (iv) to have provided inaccurate information on any legal documents submitted in connection with the Promotion; or (v) to be acting in violation of these Official Rules.  ANY VIOLATION OF THESE OFFICIAL RULES BY A WINNER WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS A WINNER OF THE PROMOTION AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED.  

11. GENERAL CONDITIONS: Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Promotion should a virus, bug, computer or phone problem, unauthorized intervention or other causes beyond Sponsor’s control, corrupt the administration, security or proper play of the Promotion.  Any attempt by any person to deliberately damage the Promotion Site or related websites or undermine the legitimate operation of the Promotion may be in violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.  The Released Parties are not responsible if the Promotion cannot take place or is delayed, or if any Prize cannot be awarded due to delays, interruptions or failures due to acts of God, war, natural disasters, coronavirus (COVID-19) pandemic, other epidemics or medical emergencies, government mandated lockdowns, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, other force majeure events or other events outside of the reasonable control of the Released Parties.  If, for any reason, the Promotion is not capable of running as planned, including, without limitation, coronavirus (COVID-19) pandemic, other epidemics or medical emergencies, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Released Parties, which, in Sponsor’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Promotion or any part of the Promotion.  Only the type and quantity of Prizes described in these Official Rules will be awarded unless Sponsor modifies the Prize(s) at its own discretion due to unavailability.  If due to a printing, technological, mechanical, electronic, or any other error, more Prizes are claimed than are intended to be awarded as set forth in these Official Rules, the intended Prizes will be awarded in a random drawing from among all e-mail addresses collected in the administration of the Promotion.  In no event will more than the stated number of Prizes be awarded.  The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, then the Official Rules will be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.  

In the event a Prize is mailed or emailed to a winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. Sponsor is not responsible for the safe arrival of a prize. Sponsor is not responsible if potential winner does not receive his/her prize because erroneous, expired, canceled, fraudulent, or fake information was provided during the Sweepstakes. 

12. LIMITATIONS OF LIABILITY: Except as provided by applicable law, the Released Parties are not responsible, to the extent permitted by law, for: (a) any incorrect or inaccurate information, whether caused by any Eligible Person or other person, printing errors or omission or by any of the equipment or programming associated with or utilized in the Promotion; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, lost or unavailable network connections, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Promotion; (d) incomplete, garbled, or delayed computer transmission whether caused by Sponsor, Entrant, or by any of the equipment or programming associated with or utilized in the Sweepstakes, (e) technical or human error which may occur in the administration of the Promotion or the processing of entries; (f) any injury or damage to person or property which may be caused, directly or indirectly, in whole or in part, from participation in the Promotion or receipt or use or misuse of any Prize; or (g) electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in Eligible Person’s device to receive messages.  If for any reason an Eligible Person’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Eligible Person’s sole remedy is another entry in the Promotion during the Promotion Period.  

NOTHING IN THESE OFFICIAL RULES SHALL DISCLAIM, LIMIT, OR EXCLUDE LIABILITY FOR ANY LIABILITY THAT MAY NOT BE DISCLAIMED, LIMITED, OR EXCLUDED PURSUANT TO APPLICABLE LAW.  

13. PRIVACY POLICY: Participants acknowledge and understand that all personal information submitted as part of this Promotion will be collected and processed by Sponsor and its Data Processor, Playable Aps (previously named LeadFamly Aps), a company with its registered office in Brendstrupgaardsvei 13.1, Arhaus, 002 8200, Denmark, who is the developer of the platform hosting the Swarovski Online Advent Calendar, for the purpose of managing the Promotion, and such additional purposes specified in connection with entering or participating in the Promotion, in accordance with the privacy policy available at  https://www.swarovski.com/en-US/s-dataprotection/Privacy-Policy/ (the “Privacy Policy”).  Personal information collected and processed for the purposes of managing this Promotion include Entrants´ identification and contact information; entries in the Swarovski Online Advent Calendar games; winner or loser status, prizes awarded, prizes redeemed, communication in connection with this Promotion and any information voluntarily provided by Entrants. In addition, with their consent, for Entrants who are Swarovski Club members and are logged in their account when they enter this Promotion, Sponsor will also collect preferred products lists from (i) Swipe It; (ii) Product selector; (iii) Drop game and (iv) Priority puzzle games and process this personal information for the purposes of personalizing offers and communications to them in accordance with the Swarovski Club Terms and Conditions and privacy policy available at https://www.swarovski.com/en-US/s-sctermsandconditions/. Participants can read more about their rights, how their personal information is used, and how to contact Sponsor, in the Privacy Policy.  By participating in the Promotion, participants agree to the Terms of Use and the terms and conditions of the Promotion Site, and acknowledge all of the terms and conditions of the Privacy Policy. 

14.DISPUTES: In the event of printing error in these Official Rules, illegality, or circumstances beyond the reasonable control of Sponsor that prevent the administration of the Promotion, Sponsor reserves the right to amend these Official Rules or withdraw the Promotion.  Sponsor shall not be liable for any form of loss or disappointment caused by any alterations to these Official Rules or withdrawal of the Promotion.  In such circumstances, Sponsor will make all reasonable endeavors to advise Entrants of any changes or withdrawal.  To the fullest extent permitted by applicable law, participant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state and federal courts located in the State of Rhode Island; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (3) under no circumstances will an Entrant be permitted to obtain an award for, and an Entrant hereby waives all rights to claim, indirect, punitive, incidental, and consequential damage and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Rhode Island without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of Rhode Island.  

15.WINNERS LIST/OFFICIAL RULES: For the names of the winners who won a Prize (valued $100 or more) and/or Official Rules, please send a self-addressed and stamped envelope to Swarovski Online Advent Calendar Promotion, Attn: Legal Department, One Kenney Drive, Cranston, Rhode Island 02920.  The envelope must indicate whether a copy of the winners list or Official Rules is requested. Requests must be received by January 31, 2024.
