Customers accessing the website www.swarovski.com, www.swarovski.co.jp, www.swarovski.jp, or any other Swarovski domain (hereafter referred to as "the Website") of Swarovski Crystal Online from, or with shipping addresses in, Japan are subject to the following Terms and Conditions. This customer information and these General Terms and Conditions shall apply to your use of, and all orders for the sale of good placed through the Website. The General Terms and Conditions apply equally to those goods ordered using the Website by direct order or through an account which you may establish through the Website. By placing an order with Swarovski, you confirm that you have read, understood, and accepted these General Terms and Conditions and the Swarovski Privacy Policy and Statement. If you object to any of these General Terms and Conditions or those of Swarovski's Privacy Policy and Statement, please discontinue using the Website and refrain from placing an order (as applicable). In these General Terms and Conditions, “Swarovski” or “the companies” means, Swarovski Crystal Online AG, Swarovski Japan Ltd. and/or Swarovski.

Swarovski reserves the right to make changes to these General Terms and Conditions. The goods and prices on the Website are also subject to change. Customers should revisit this area of the Website immediately before placing an order. Any changes will only be effective once they are published on this Website.

This Website is not intended for use by children, especially those under 12 years of age. If you are under twenty years of age, you must obtain the consent of your parent or legal guardian before disclosing any personal information or making any purchases from this Website.

When you visit this Website, order any goods from this Website or send emails to, you are communicating with us electronically. Visits to, orders from, or emails sent to the Website are considered electronic communications.

Unless Swarovski is otherwise advised by you, the user, registering your contact details automatically gives your consent to being contacted directly by the company by phone or electronic message (or by other electronic messaging means) without prior written consent. Please be aware that your information (including your contact information) is required to enable the company to complete your purchase of Swarovski goods. By registering with Swarovski, you are expressly consenting to such use of your data. Registration cannot be completed without this consent. If you object, those parts of the Website that do not require registration will be available for your use. If you decide to register at a later date, you may view and modify your data anytime by selecting Profile from the website menu.

Copyright of the Website and the contents included on the Website belong to Swarovski or its licensors.

6. Disclaimer and limitation of liability
To the extent permitted by law, all implied warranties and conditions, representations about the Website, your accessibility to and use of the Website, and any goods available for purchase from the Website are excluded from these General Terms and Conditions. In particular, to the extent permitted by law, and except for the Swarovski warranty provided in Paragraph seven, where you consider that an item purchased through this Website does not meet your expectations, your sole remedy is to follow our Return Policy, which is provided for in Section six below, entitled "Your Purchase Agreement".

Swarovski will provide all content and other services on the Website in good faith and will use reasonable endeavours to ensure that the information on the Website is accurate and current at the date of publication. However, to the extent permitted by law, Swarovski is not liable for any inaccuracies, errors, or omissions in the content, including content relating to the description of goods. While all reasonable efforts are made to ensure that the description of goods on the Website accurately portrays the actual article, variances may occur between depictions and the actual article.

If a term is implied by law in these General Terms and Conditions (regarding goods or services provided by Swarovski through the Website), including in relation to goods you purchase through this Website, and the law prohibits provisions in a contract excluding or modifying liability under that term, then it will be included in these General Terms and Conditions.

However, Swarovski’s liability for breach of such a term will, to the extent permitted by law, be limited to, at its discretion, the supply of the relevant service or services or the payment of the cost of having the goods or services supplied again.

To the extent permitted by law and, except as provided for by these General Terms and Conditions, Swarovski (and its officers, employees, agents, or related corporate bodies) is exempt from all liabilities, however caused, (including in contract, negligence, or otherwise) for any losses, damage, costs, or expenses suffered by you or claims made against you in connection with:

- your use of the Website;
- any lack of availability, interruptions, delays in operation, viruses, internet access difficulties, or equipment malfunctions in relation to the Website;
- any failure to provide the Website;
- any goods supplied, offered, or advertised on the Website; or
- your purchase of any goods or services offered by Swarovski for sale on this Website.

7. Indemnity
To the extent permitted by applicable law, you hold Swarovski and its affiliates, employees, agents, representatives, and its third party service providers harmless from any and all claims and liabilities (including fees incurred on a solicitor-client basis) that may arise in connection with your use of this Website, your purchases made from this Website, and the use of Swarovski goods.

8. Termination
Swarovski may suspend, terminate, or limit your access to the Website effective immediately, if, in its reasonable opinion, these General Terms and Conditions have been breached. Swarovski may, at any time, suspend, limit, or terminate any service provided on the Website or all access and use of the Website.

9. Cookies
Cookies are a standard for storing small pieces of data on your computer. Any web server (including this one) may store one or more cookies in your browser or request your browser to transmit the data to the web server.

Swarovski may use cookies to control the display of advertisements, to track usage patterns on the site, to deliver editorial content, to record registration, and to personalize information. For example, if you register on any part of the Website, you can opt to save your user name and password on your computer. Swarovski can provide this function by placing a cookie on your computer. Its cookies may contain personal information and may be shared with related corporate bodies. If you don't want cookies, your web browser likely includes an option that allows you to disable them. 10. Your purchase agreement
This section applies to any order made through the Website (either through a direct order or through the establishment of an account).

1. The purchase agreement

Any orders made through the Website (either through a direct order or through the establishment of an account) constitute a binding agreement to conclude a purchase agreement with Swarovski Japan Ltd. A binding purchase agreement only comes into existence when Swarovski accepts your order by dispatching the goods ordered by you to an affiliate delivery service. Swarovski will notify you when goods are dispatched by sending you an email. The General Terms and Conditions apply to, and are incorporated into, any purchase agreement for goods purchased on the Website.

You will be charged the prices and fees displayed on the Website at the time that your order is submitted. The price of an item cannot be confirmed until an order is submitted. Your credit/debit card or alternative payment methods will not be charged until after Swarovski accepts your order, as explained in Section 4 below.

All of the terms of the United Nations Convention on Contracts for the International Sale of Goods (adopted in Vienna, Austria, on April 10, 1980) are expressly excluded from these General Terms and Conditions and any purchase agreement.

Click & Reserve

We may give you the option of checking the availability of certain Products and reserving Products in specified Swarovski Stores through the Websites (“Click & Reserve”). If the Product is available, it will be reserved for you for two (2) business days from notification to you. You can purchase the Product in the applicable Swarovski Store. Prices in the Swarovski Stores may vary from the Prices displayed on the Websites.

 

Click & Collect

We may give you the option of purchasing a Product online and picking it up on the same business day in a designated Swarovski Store (if it is available in the store) or after several business days (“Click&Collect”). If the order is not collected within seven (7) business days of Us sending you a confirmation email. We will assume that it is unwanted, cancel the order and section 10.6. will apply. When you are collecting Products you have purchased via “Click & Collect”, you may be required to bring to the Swarovski Store original photographic proof of your identity (such as a passport or identity card) together with your payment card used to place the order (if applicable).

 

Pre-Order

We may invite you from time to time to pre-order selected Products online before they are available from Swarovski stores or websites (“Pre-Order Products”).

You agree that if you order a Pre-Order Product, you will be charged in case of use of a credit card after your item has shipped, in case of use of any other payment method you will be charged shortly after you place your order and before your item is dispatched. Kindly note that irrespective of the means of payment, in case you pre-order more than one type of product, you will be charged shortly after you place your order and before your item is dispatched.

Notwithstanding the foregoing, your payment method may reflect the deduction of the purchase price immediately upon placing the order. Please note your order is not confirmed until payment has been taken. Pre-Order Products will be shipped within the period as stated on the product page (in most instances this will be at latest between 6-8 weeks from the date the order is placed).  Please note that the following delivery options offered on the Website shall not apply to orders of Pre-Order Products: Click & Reserve; Buy Online Pick up in Store. The Click & Collect option will only be possible in certain countries and based on the delivery times mentioned on the product page. Pre-orders can be cancelled before Pre-Order Products are shipped.

2. Reservation of performance in case of goods being unavailable

Swarovski does not warrant and cannot guarantee that goods ordered will be available at all times.

Also, if the goods ordered are no longer able to be supplied to you within thirty days of your order being accepted, Swarovski can withdraw from, and terminate, any purchase agreement entered into with you for those goods. If Swarovski withdraws from and terminates a purchase agreement, then it will immediately inform you by email and will immediately refund any fees or charges already paid by you for the goods.

Swarovski reserves the right to limit the number of products (or the number of a particular SKU) that may be sold to a customer.

Swarovski reserves the right to reject orders from customers if there is reasonable belief that customer is in violation of these Terms and Conditions, or if customer is engaging in fraudulent or other criminal activities.

3. Price and additional costs

The total amount for any goods ordered must be made as a single payment. The total amount of your order, including all taxes and costs such as packaging and delivery, will be displayed during the checkout process when you submit your order.

4. Terms of payment

The purchase price for all goods ordered is due and payable when Swarovski notifies you that your order has been accepted. Swarovski will only process the transaction once you have been notified of your accepted order.

You may not make any set-off claims against Swarovski's claim for payment unless the amount set-off is not disputed by Swarovski or has been the subject of a final and binding judgment against the company.

Prepayment: For special orders (e.g. high order amount, Limited Editions) Swarovski offers the possibility to pay via prepayment. Your order will be processed upon receipt of your payment into our bank account. The amount is due for payment immediately.

Please transfer the amount to the account listed in the checkout process using your order number as payment reference. Please note that your bank may charge additional costs for international bank transfers.

In case the payment amount is not transferred to our bank account within 7 banking days after receiving the order confirmation, Swarovski has the right to cancel your order.

An invoice will also be sent with your package. Prepayment is not available for Electronic Gift Cards.
Payment may be by credit/debit card (by entering your card data on the Website), or by PayPal or by other alternative payment methods (by entering your payment data on the Website / App of the respective payment provider). Swarovski reserves the right, to add or remove payment methods from time to time to its discretion.
If you pay with a credit/debit card or alternative payment methods, we reserve the right to check the validity of the card, to monitor the availability parameters for collection and the address data and to ask for authorization by the card issuer or payment method provider. You confirm that the credit/debit card or payment method that is being used is yours and that all details you provide to us in respect thereof including, without limitation, name and address details are complete, correct and accurate. You further confirm that the credit/debit card is valid and the inputted payment details are correct. If the institution that issued the credit card or payment method refuses to authorize payment to us, we will not accept your order and we are not liable for any delays or for failure to deliver and we are not obliged to inform you of the reason for the refusal.
We are not responsible for any charges or other amounts which may be applied by your card issuer or bank or payment method provider as a result of our processing of your credit/debit card payment or other method of payment in accordance with your order.
If your credit/debit card or payment method is not denominated in the currency of your purchase indicated on the Website, the final price may be charged in the currency of your card or account. Such final price is calculated and charged by your card issuer or bank or payment method provider and therefore we shall not be responsible for any cost, expense, charge or other liability which may be incurred or suffered by you as a result of your card issuer or payment method provider charging you in a different currency other than the currency of your purchase as displayed on the Website.

5. Delivery and reservation of title

Orders will be delivered to the delivery address stated in your order. Deliveries are made by the delivery service appointed by Swarovski. You will be advised of the contact details of the delivery service when your order is accepted.

Swarovski makes reasonable efforts to ensure that orders are delivered within the estimated time frame on this Website or at the time when your order is accepted. However, Swarovski makes no guarantees in relation to estimated delivery times. You agree that the products ordered and sent to you remain Swarovski Japan Ltd.’s property until full payment has been received by the company. Swarovski requires full payment prior to the dispatch of the purchased goods to the delivery service.

All goods purchased from this Website are delivered pursuant to a contract with Swarovski’s delivery service. This means that the risk of loss and title for the goods passes to you upon delivery of the goods to the delivery service. Swarovski is not responsible for the risk of loss of goods during their delivery to you by the delivery service, unless otherwise advised. In the case of signature release delivery, the delivery will be completed when Swarovski hand over the goods to the carrier at the designated location ( e.g at the front door).

6. Right to cancel the purchase agreement

Purchased items may be unconditionally returned within 14 business days after the date of their receipt. However, items must be returned in their original condition and mailed back to Swarovski within 14 business days of the date of their receipt.

If you decide to return only part of an order that has been purchased with a discount/offer applied, the amount refunded will be subject to the minimum purchase amount placed on the offer, the value of the discount will be adjusted accordingly, and only the amount relevant to the returned item will be refunded. If the items returned bring the remaining total below the minimum purchase level of the offer, then the discounted amount will be deducted from the refund amount. For example, a 10% discount (with a minimum purchase amount of JPY 100) will be removed if the returned product(s) brings the total order value below JPY 100. In case of a promotion with staggered prices, always the lowest amount will be refunded.

For items which come in a single box (“normal set”), if you wish to return any of the items within the normal set, you will have to return all the items that were part of the normal set.  Swarovski will not accept returns of individual items within the normal set and will only accept returns of the entire normal set.

For bundle-promotional sets, where you enjoy a promotion or discount as a result of purchasing one or more items (e.g. buy 3 items and get 10% off each item or where savings for each product are stated), you can return any of the items purchased separately. However, in case you choose to return any items purchased as a bundled set, kindly note that Swarovski will adjust the promotional price by charging you the regular price for the remaining items that you purchased as part of the bundle. Accordingly, Swarovski will deduct from the amount to be refunded to you (i.e. the discounted price paid for the item(s) in the bundle that you have returned) the difference between the regular price and the discounted price of the remaining items in the bundle that you do not return.

7. Warranty in relation to goods

Swarovski is happy to extend a one year warranty on its products beginning on the date of receipt of goods, except for watches which come with a two year warranty. If delivered goods prove to be defective within this period, you may terminate the purchase agreement (and upon return of the defective goods, Swarovski will refund the price paid for the goods purchased under the agreement); or, if the product(s) is still available, you may request its replacement by giving a notice within a reasonable amount of time. To the extent allowed by law, Swarovski provides no further warranty in relation to the goods purchased from the Website.

8. Liability in relation to goods

Swarovski’s liability is limited in accordance with the section entitled Disclaimer and Limitation of Liability, which also applies to any purchases of goods offered on the Website. Please refer to this section.

9. Prohibition of assignment

You may only assign or transfer your rights of any purchase agreements to a third party with Swarovski Crystal Online's prior written consent.

10. Applicable law

Any purchase agreement shall be governed by the laws of Japan.
Any action relating to rights and obligations under this Agreement shall be submitted to the Tokyo District Court as the agreed exclusive court with jurisdiction of first instance.

11. Export control and sanctions

Swarovski will screen the Customer’s personal data with relevant export control and sanctions lists. Screening will occur with every update of any sanctions list. The Customer hereby certifies that the present Purchase Order and the implementation thereof will not in any way benefit, directly or indirectly, any natural or legal person that is named on any relevant sanctions list, such as the “Consolidated list of persons, groups and entities” subject to EU financial sanctions and U.S. OFAC’s “List of Specially Designated Nationals and Blocked Persons (“SDN”)”.

This Purchase Order only becomes effective, if any export control and sanctions relevant screenings made by Swarovski at the time of dispatch of the ordered goods do not lead to a match. In case of any breach of this clause or any breach of trade law or export control regulations or sanctions, particularly in case that any screenings made by Swarovski lead to a match, this Purchase order will not come into force and Swarovski will neither be obliged to deliver any goods nor any compensation for non-performance will be due. Open orders shall be rescinded immediately. Notwithstanding the aforementioned, Swarovski shall be entitled to stop any delivery of goods, if any export control regulations and trade restrictions so require. Any compensation for non-performance shall be excluded.

Toute commande de nos produits implique l'acceptation des dispositions ci-après énoncées ainsi que la confirmation selon laquelle la personne dispose de la capacité de conclure des contrats contraignants et qu'elle est âgée de plus de 18 ans. Nous ne saurions reconnaître les dispositions dérogeant aux présentes Conditions générales de vente qu'à la condition qu'elles aient été confirmées par écrit par nous-mêmes. 3. Conclusion du contrat
En passant vos commandes sur le Site Internet, vous remettez des offres fermes de conclusion de contrats de vente avec la société Swarovski Crystal Online AG. Nous nous réservons le droit, dans les 14 jours suivant sa réception, d'accepter une telle offre ou de la refuser en vous envoyant une explication conforme. Le contrat de vente ferme sur les marchandises commandées se forme après acceptation par nous-mêmes de votre commande. L'envoi des marchandises commandées vaut acceptation de la commande.

Vous consentez expressément à la vérification de votre solvabilité par le biais d'une demande d'information soumise aux associations de protection du crédit, aux établissements de crédit et aux agences de renseignements. En cas de réponse négative concernant votre solvabilité, nous pouvons, à notre entière discrétion, refuser l'acceptation de la commande. En outre, nous nous réservons le droit de refuser les commandes de clients lorsqu'il y a lieu de croire que le client enfreint les présentes Conditions générales de vente, lorsqu'il prend part à des activités frauduleuses ou à d'autres activités contraires à la loi ou en cas d'autres causes majeures.

4. Disponibilité
Les produits et les prix sont conformes à la présentation du Site Internet ; les produits sont disponibles dans la limite des stocks. Nous nous réservons le droit de modifier à tout moment les produits figurant sur le Site Internet, et ce, sans annonce préalable, et de limiter le nombre d'articles qu'un visiteur peut acheter. 

Nous déclinons toute responsabilité en cas de stocks insuffisants ainsi qu'en cas de non-disponibilité des produits. 

La revente à des fins commerciales ou la commercialisation de produits Swarovski ayant été achetés sur le Site Internet est strictement interdite.

5. Réserve d'exécution en cas de non-disponibilité des marchandises
Si la marchandise commandée n'est pas livrable dans les 30 jours suivant votre commande, nous sommes en droit de résilier le contrat, et ce, même si nous avons préalablement confirmé la conclusion celui-ci. En cas de résiliation, nous vous tiendrons informé(e) de la non-disponibilité de la marchandise et vous rembourserons les contreparties versées jusqu'alors.

6. Prix et coûts supplémentaires
Le prix total de votre commande, y compris l'ensemble des frais d'envoi et des frais supplémentaires, est indiqué sur la page précédente ou à l'issue du processus de contrôle. En confirmant la commande, vous déclarez être en accord avec le prix indiqué pour les marchandises. Le prix ne saurait être modifié ultérieurement. 

La vente des produits Swarovski est effectuée par la société Swarovski Crystal Online AG dont le siège est basé en Suisse. Nous souhaitons porter à votre connaissance le fait que les paiements de l'étranger réalisés au moyen d'une carte de crédit sont susceptibles de faire l'objet de frais au titre du chiffre d'affaires sur l'étranger (de l'ordre de 1 à 2 %) de la part de l'établissement vous ayant délivré la carte de crédit.

7. Conditions de paiement
L'exécution de votre commande par Swarovski Crystal Online rend le prix d'achat des marchandises commandées exigible. Le paiement peut être effectué par carte de crédit (en saisissant les données relatives à la carte sur le Site Internet) ou sur facture pour les clients résidant en Allemagne, Autriche et en Suisse (y compris au Liechtenstein). Vous ne pouvez compenser notre droit au paiement qu'à condition que la créance soit incontestée et constatée judiciairement par décision ayant acquis force de chose jugée.

Prépaiement :

Lors de commandes spéciales (ex : commande d’un montant élevé, Editions limitées) Swarovski offre la possibilité de verser un prépaiement. Votre commande sera traitée dès la réception de ce paiement sur notre compte. Le montant est dû immédiatement. 

Veuillez effectuer un virement sur le compte indiqué lors du processus de paiement en vous servant de votre numéro de commande comme référence de paiement. Il est possible que votre banque facture des frais additionnels pour les virements bancaires internationaux. 

Swarovski se réserve le droit d’annuler votre commande si aucun paiement ne parvient sur notre compte dans les 7 jours ouvrés suivant la confirmation de commande. 

Une facture sera envoyée avec le colis. Le prépaiement n’est pas effectuable avec des Cartes Cadeaux électroniques.

8. Livraison et réserve de propriété
La livraison des marchandises commandées est effectuée par le service de distribution mandaté par nous-mêmes. Elle intervient en règle générale dans les 5 à 7 jours ouvrables suivant le jour ouvrable auquel votre commande a été passée et à l'adresse que vous nous avez indiquée. Veuillez compter un délai de livraison supplémentaire de 2-3 jours ouvrables pour les produits personnalisés. Vous pouvez consulter les jours fériés lors desquels aucune livraison n'est effectuée sur notre assistant boutique en ligne. Au cas où vous demandiez à recevoir les marchandises à une date fixe, nous nous efforcerions de satisfaire votre souhait sans que cela ne revête communément de caractère contraignant. 

La marchandise demeure notre propriété jusqu'au règlement complet du prix d'achat.
Il convient de vérifier l'exactitude et l'intégralité de l'envoi au moment de la livraison.

9. Droit de rétraction
Tout consommateur est en droit d'annuler sa commande et donc de résilier le contrat sans indiquer quelque raison que ce soit, dans les 14 jours suivant la réception de la marchandise. Ledit délai de 14 jours prend effet à compter du jour de la réception de la marchandise. Vous n'êtes plus lié(e) par votre commande dès lors que vous faites usage de ce droit dans le délai imparti. Les produits personnalisés sont exclus du droit de rétraction. 

Pour obtenir de plus amples informations et une aide concernant la restitution des marchandises commandées ainsi que l'adresse de retour correspondant à votre pays, veuillez consulter notre Site Internet sous le menu « Service clientèle - Retours». 

L'annulation de la commande peut s'effectuer par écrit ou sur un autre support de données durable à l'adresse indiquée au point 2 ou par le biais du renvoi de la marchandise à l'adresse indiquée sur notre Site Internet au menu « Service clientèle - Retours». Pour être en conformité avec le délai imparti, il suffit de renvoyer la marchandise dans les délais. Le produit doit être dans son état et son emballage d'origine ; les produits doivent être accompagnés du bordereau de retour. 

En cas de retour, vous êtes dans l'obligation d'effectuer le renvoi de la marchandise à l'adresse indiquée sur notre Site Internet sous le menu « Service clientèle - Retours». L'envoi s'effectue aux frais et risques de Swarovski Crystal Online AG, les frais standard (envoi standard non assuré) vous revenant toutefois si le montant de la commande n'excède pas 40 euros, sauf si la marchandise livrée ne correspond pas à la marchandise commandée. Le renvoi de la marchandise doit intervenir dans les 14 jours suivant la déclaration de retour. 

Seules les marchandises envoyées à l'adresse indiquée ci-dessus, non utilisées et dans leur état d'origine peuvent faire l'objet d'un remboursement de frais. Veuillez noter qu'en cas de paiement au moyen de carte cadeau, le remboursement du montant versé ne saurait avoir lieu que sous la forme d'un bon à valoir. En cas de paiement partiel au moyen d'un bon à valoir, celui-ci serait dans un premier temps endossé puis inscrit au crédit du compte au moment du renvoi. 

Vous êtes dans l'obligation de prendre en charge les frais standard de renvoi lorsque la marchandise livrée correspond à la marchandise commandée et lorsque le prix des articles retournés n'excède pas un montant de 40 euros ou lorsque, dans le cas d'un montant supérieur, vous ne vous êtes pas acquitté(e) de la contrepartie ou d'un paiement partiel prévu par le contrat au moment de l'annulation. Le renvoi est gratuit dans les autres cas. 

Les frais de livraison et les frais de retour (pour une valeur de marchandise supérieure à 40 euros) ne sont remboursés qu'à hauteur du montant des coûts standard. 

Les bons et les produits personnalisés ne peuvent normalement pas être remplacés ni retournés.

Il est impossible pour l'heure de rembourser via le Site Internet des marchandises achetées dans les boutiques Swarovski.

Si vous décidez de ne retourner qu’une partie d’une commande qui a été payée en utilisant une remise/une offre spéciale, le montant remboursé sera fonction du montant minimum d’achat conditionnant l’offre. La valeur de la remise sera ajustée en fonction, et seul le montant correspondant à l’article retourné sera remboursé. Si du fait des articles retournés, le montant total restant est inférieur au minimum d’achat imposé par l’offre, alors le montant remisé sera déduit du montant remboursé. Par exemple, la remise de 10 % (offerte avec un montant minimum d’achat de 100) sera supprimée si, en raison du retour du/des produit(s), le montant total de la commande est inférieur à 100.

10. Garantie
En cas de livraison d'une marchandise défectueuse, il vous est loisible d'annuler le contrat ou, si la marchandise est encore livrable, de demander le remplacement de celle-ci par un exemplaire sans défaut. Aucune garantie séparée ne sera consentie de surcroît.

Le délai de garantie des vices cachés est de deux ans à compter de la réception de la marchandise.
11. Responsabilité
La société Swarovski Crystal Online AG ne saurait être tenue responsable envers vous que des dommages causés intentionnellement ou par négligence grave. 

La restriction de la responsabilité mentionnée ci-dessus s'applique à l'ensemble des droits à réparation, quel qu'en soit le motif juridique, y compris les actions illicites ; elle ne s'applique pas à une éventuelle responsabilité découlant de la loi sur la responsabilité du fait des produits, en vertu d'une qualité juridique garantie ou en raison de la mise en danger de l'intégrité physique ou de la vie d'autrui. 

L'exclusion ou la limitation de la responsabilité civile au titre de dommages selon le paragraphe précédent s'applique également dans le cas de recours éventuels contre les employés ou les mandataires de la société Swarovski Crystal Online AG.

12. Clause de sauvegarde
Au cas où une des dispositions des présentes Conditions générales de vente s’avérait ou devenait nulle ou inapplicable, la validité des dispositions restantes n’en serait pas affectée.

13. Interdiction de cession
La cession de vos droits légaux à un tiers ne saurait s'effectuer qu'avec l'autorisation écrite de la société Swarovski Crystal Online AG.

14. Droit applicable
Les contrats conclus selon les présentes Conditions générales de vente sont soumis au droit suisse à l'exception d'un éventuel renvoi à un droit étranger. La Convention des Nations Unies sur les contrats de vente internationale de marchandises est exclue. Ce choix du droit applicable n'est valable que dans la mesure où des dispositions impératives du droit de l'État de résidence du consommateur ne s'y oppose pas. Tout litige survenant du fait des présentes Conditions générales de vente ou en lien avec celles-ci sera soumis à la juridiction exclusive des tribunaux de Zurich. La société Swarovski Crystal Online AG se réserve également le droit d'intenter une action au lieu de résidence du client
